Terms of Service
These Terms of Service ("Terms") govern your use of the IMgest application and related services (the "App"), provided by LIMOD ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The service
IMgest is a desktop application for Windows 11 and macOS that helps you import photos and videos from memory cards and other storage into a library folder you choose. It verifies copies, removes duplicates, generates folder names using AI, and produces import reports. The App is licensed, not sold, to you for use under these Terms.
2. Eligibility
You must be at least the age of majority in your place of residence, or have the consent of a parent or legal guardian, to use the App and make purchases.
3. Plans, credits, and billing
- IMgest is free to download and includes a monthly allowance of AI folder names at no cost.
- Paid plans (such as Pro and Starter) and one-time credit packs provide additional AI folder-naming usage, as described on our Pricing page.
- Payments are processed by Paddle.com, which acts as the Merchant of Record for all purchases. Your purchase is also subject to Paddle's Buyer Terms. We do not collect or store your payment card details.
- Pro and other auto-renewing subscriptions renew until cancelled. You can cancel at any time; access continues until the end of the current billing period. Starter is available only on a first purchase, can be bought once, lasts 12 months, and does not renew.
- One-time credit packs expire 3 months after purchase. Plan allowances refresh monthly and do not roll over.
- Prices are shown in US dollars and may vary by region and applicable taxes, which Paddle calculates at checkout.
4. Refunds
Refunds are governed by our Refund Policy and are processed through Paddle.
5. Acceptable use
You agree not to: (a) reverse engineer, decompile, or attempt to extract source code or secrets from the App except where permitted by law; (b) resell, sublicense, or redistribute the App or paid usage without our written permission; (c) abuse, automate, or circumvent usage limits or the AI naming service; or (d) use the App for any unlawful purpose or to process content you do not have the right to process. The restriction in (a) does not apply to inspecting, modifying, replacing, or debugging the LGPL-covered FFmpeg components as permitted by their license.
6. Your content
You retain all rights to the photos, videos, and files you process with the App. Your full-resolution media is handled on your device. When you enable AI folder naming, only downsized, metadata-stripped thumbnails and limited text metadata are sent to our AI providers, as described in our Privacy Policy.
7. Intellectual property
The App, its design, and its trademarks are owned by us and our licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for your own personal or internal business purposes.
This license for the binary App applies to copies distributed through Microsoft Store and our
direct distribution channels. Source code published in the
IMgest repository
is licensed separately under the PolyForm Noncommercial License 1.0.0 stated in that repository's
LICENSE file. These Terms do not expand the source-code license.
The App includes FFmpeg and ffprobe under the GNU Lesser General Public License version 2.1
or later (LGPL-2.1-or-later), separately from IMgest's own license. Complete license texts and
notices are included in the platform-specific app package (under
IMgest.app/Contents/Resources/licenses/ffmpeg/ on macOS and
_internal/licenses/ffmpeg/ on Windows). The exact FFmpeg 8.1.2 source archive is provided with our release artifacts on the
public releases page
and is also available from FFmpeg.
8. Third-party services
The App relies on third-party services (including Paddle for payments, Cloudflare, and AI providers such as Google and Anthropic) to deliver certain features. Your use of those features is also subject to those providers' terms.
9. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. While IMgest is designed to import your media safely and to never modify or delete originals except via an explicit opt-in, you remain responsible for maintaining your own backups. We do not warrant that AI-generated folder names will be accurate or suitable for any purpose.
AI folder naming is a best-effort feature that depends on third-party services and network connectivity; copying and verifying your photos works without it. If a backend outage causes an AI request to fail, that item is not charged against your allowance, and where a charge was already made it is refunded.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or media, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim arose.
Nothing in these Terms affects your statutory rights as a consumer that applicable law guarantees and does not allow to be excluded or limited (including, where they apply, the Republic of Korea's Act on the Regulation of Terms and Conditions and Act on Consumer Protection in Electronic Commerce, the EU Digital Content Directive 2019/770, and the UK Consumer Rights Act 2015).
The limitations and exclusions of liability above do not apply to our wilful misconduct or gross negligence, fraud, or any liability that cannot be excluded by law (such as for death or personal injury).
If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full force and effect, and the invalid provision will be limited or reduced to the minimum extent necessary so that it is valid and gives the closest effect to its original intent.
11. Termination
You may stop using the App and uninstall it at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination will survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and where appropriate notified within the App. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Republic of Korea, without regard to its conflict of laws rules, except where mandatory consumer-protection laws of your country of residence apply. Nothing in these Terms affects the separate role of Paddle as Merchant of Record for your purchase.
